Need Feedback on Upload Rules

Here's the current draft of upload rules as follows:

Sanctuary uploads are governed by the Seven Deadly Sins of Sanctuary found here. Violating any of those rules whatsoever will earn you an instant ban or even an instant permaban along with the swift deletion of any offending content. The Seven Deadly Sins are set in stone and are not up for debate. Do not test us with this.

In addition to the Seven Deadly Sins, uploads are also governed by these specific rules below. Violations of the rules below are treated much more leniently, but will still earn you an infraction if violated along with the deletion of the offending content. Any infraction on an account will disappear permanently after three days, but if you receive another infraction when you already have an infraction on your account, you will be banned with the length of time determined by the member of staff who banned you.

Sanctuary sometimes does condone piracy, but we don't condone MINDLESS piracy. Uploading of copyrighted material is not allowed UNLESS,
- the material was copyrighted 20 years ago to the day or more, or
- it is no longer for sale, or
- the copyrighted material is within a mod for a particular type of software or hardware that still requires the software or hardware to function, or
- it is still for sale and the copyright is within 20 years to the day, but the price for the item is way too expensive for what it is, or
- it is still for sale and the copyright is within 20 years to the day, but has a mandatory subscription added onto it, or
- it is still for sale and the copyright is within 20 years to the day, but the copyrighted item has DRM attached to it. (This includes all Blu-Ray movies and shows and almost all DVD movies and shows.)

Uploading of classifed government secrets and NDA material is not allowed UNLESS there is explicit admin approval for it. It is highly recommended that you upload it to Distributed Denial of Secrets instead though regardless.

WHATEVER YOU UPLOAD HERE CAN BE SEEN BY ALL SANCTUARY STAFF REGARDLESS OF IF THE RESOURCE IS MARKED AS PRIVATE OR NOT. IF YOU WISH FOR ABSOLUTE PRIVACY, PLEASE ENCRYPT YOUR STUFF FIRST WITH SOMETHING LIKE VERACRYPT.

As you can see, the list of exceptions for copyrighted material is long and clunky. Too long. It's not nearly as elegant as I'd like it to be, but I fear if I start shortening it down from what it is, I'm either going to have to prohibit something that shouldn't be prohibited at all, or I'm going to have too much leniency and innocent sellers are going to get caught in the crossfire.

So what's everyone's take on these rules?

>it is no longer for sale

Does this mean "no longer for sale globally?" or only "in your country"? Something may be for sale in Japan, but not in the United States.

> but the price for the item is way too expensive for what it is

This is subjective.

> but has a mandatory subscription added onto it

Sure, if you want people to upload HBO, Disney+, Netflix, and Amazon Prime subscription shows. Do you want that?

> it is still for sale and the copyright is within 20 years to the day, but the copyrighted item has DRM attached to it.

This includes a whole bunch of modern games. Are you okay with that?

Honestly, it looks fine to me. If you want to clean up its appearance, you could merge the verbiage of "it is still for sale and the copyright is within 20 years to the day" across all 3 exceptions

Ah. Good point. I guess it means globally. Though if a piece of software or game isn't available for sale in your country... What are you going to do? I don't know. I could see both sides of this issue. I'll probably just say, "no longer for sale in your country," and leave it at that.

This is subjective.

Very subjective, but I'm not sure how to narrow it down any further. This is very context dependent. For example, there is no way Adobe could ethically justify charging thousands of dollars for a boxed copy of Photoshop back in the day when Microsoft Windows at its most expensive was like... What, $300 for a retail copy at the highest edition?

Sure, if you want people to upload HBO, Disney+, Netflix, and Amazon Prime subscription shows. Do you want that?

Yep.

This includes a whole bunch of modern games. Are you okay with that?

That is correct.

Will do. Edited the second draft into the OP.

By the way, expect these rules to be in flux, guys. The Seven Deadly Sins got hammered out over a long-ass time of arguing and debate. I imagine the upload rules are going to take just as long to figure out in terms of how much more or less leniency we need to give.
